Terms & Conditions



By booking a session with Zozi Photography you are agreeing to our terms and conditions


1) APPLICABLE LAW

a) The laws of Scotland shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.

b) In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.

c) If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected and the other provisions of the agreement shall remain in full force and effect.

 

2) SESSION FEE AND PAYMENT


a) A Session Fee is required at the time of booking to secure your session. An invoice will be sent to your email, please note that till the deposit is paid, there is NO confirmation of session.

b) Session fees taken for sessions are non-refundable but are transferable within availability if given at least 72 hours notice.

c) The Session Fee covers the booking process, outfits/props (dry cleaning and maintenance), editing, and photographer's talent and time for the shoot and does not include any images or products but will be deducted from the client's final payment.

d) By booking with Zozi photography you enter into a contract and have therefore agreed to abide by these terms and conditions.

e) Full payment is required in order to place an order.


3) SESSION CANCELLATION OR RESCHEDULE

 

a) Children are unpredictable, in the event of sickness or any other unforeseen circumstances please inform Zozi photography as soon as possible (not later than 2 hours to your session time). Zozi photography will try to offer an alternative date and times, if the client fails to reschedule within 1 month so the booking will be canceled and the session fee will become non-refundable.

b) If the photographer cancels the session, an alternative date will be offered where possible. Where not possible then a full refund of the session fee will be given to the client.


4) FULFILMENT OF OBLIGATIONS

a) Zozi Photography shall not be liable to the Client for any failure, in whole or in part, to fulfill its obligations where the failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. In the unlikely event of total photographic failure or cancellation of the contract by Zozi Photography liability shall be limited to a full refund of all monies paid.

 

b) The Client understands and accepts that the photographic coverage will be as Zozi Photography's professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.

 

c) If the Client fails to read the supplied messages with preparatory information and therefore fails to carry out required preparations prior to a session, Zozi Photography shall not be held responsible for any resulting reductions in quality or quantity of images supplied. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.

 

5) SESSION AND GALLERY

 

a) By booking a photoshoot with Zozi Photography you agree to allow the full artistic license to Zozi Photography. You are also acknowledging the style and colours used and agree to let the photographer choose the colours based on personal preference.

 

b) Zozi Photography shall be entitled to use its judgment regarding the style and artistic input in the production of images. This includes but is not limited to poses, props and the number of images taken. Due to the willingness of subjects, it may not be possible to capture all the pictures requested or images to the client’s full expectations.

 

c) In the event of uncooperative children at a session of any kind for any reason, Zozi Photography may not be able to capture any or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

 

d) Low resolution watermarked proofs will be available for viewing in an online gallery within 1 week of the session date. Please note that this needs to be chosen within the time frame stated in the email. Failure to do so before the gallery expires might incur additional charges.

 

e) Zozi Photography will do basic editing of photos such as exposure and colour correcting for proof galleries and full editing consisting of removing blemishes, smoothing skin, getting rid of flyaways and single strands of hair in the face will be done after full payment for the order by the clients. Please note that Advanced editing such as changing body shapes, head swaps, fixing clothes/makeup, and other major changes to images requested by the client will be carried out at an additional charge.

 

f) Final purchased images will be ready to download via private online gallery within 2 weeks of ordering date.

 

g) Delivery for prints, wall art, or any other additional products may vary. Zozi Photography will not be responsible if the product takes longer than expected.

 

h) Please note that due to the nature of the work the digital images are non-refundable.

 

 6) COPYRIGHT AND REPRODUCTION

 

a) The copyright of all and every image taken belongs to Zozi photography.

b) Zozi Photography authorises the Client the right to reproduce the images and make an unlimited number of prints for PERSONAL USE ONLY.

c) A raw or unedited image will never be given to the clients under any circumstances.

d) Client may not alter, add, filter or manipulate an image by any means or reproduce a picture in whole or in part as an element within or as a montage with another picture.

e) All produced images are done on a fully calibrated monitor and all prints will be a true reflection of the editing carried out by Zozi Photography. Zozi Photography will not be held responsible for variances in images caused by clients viewing images on non-calibrated screen, monitor and electronic devices where colour and brightness has not been calibrated. Zozi Photography is not responsible for the print quality of other print labs the Clients use.

f)  It is illegal to screenshot any images from the proof gallery. If the client is found to have screenshot images an invoice for the full gallery will be issued.

 

 7) PRIVACY POLICY

 

a) Except as required under the Applicable Law, Zozi Photography will never share or allow to be accessed, shared or distributed any personal or contact information of any client or inquiry obtained by any means. ALL contact information is protected on secure systems and password protected at all times.

b)   The following information will be collected from clients: Name and contact information including telephone number and email address. The name and age of all other client’s companions who want to be in the photos will also be asked, it is just to plan and make arrangements for the session.

c) Zozi Photography stores images for a period of 12 months thereafter they will be deleted.
